Privacy

Your privacy is important to us. Your personal information is not used outside of MenuGem®, and we do not sell or share your user data with any outside company, marketers or advertisers.

All users have the ability to opt-out of e-mail communications from MenuGem® by visiting the My Account page on the site, or by clicking the unsubscribe link that can be found at the bottom of MenuGem® e-mail messages.

If you use MenuGem® with Facebook Log in, refer to Facebook’s Terms for further information. MenuGem® is not liable for any actions in the functionality of your Facebook account or your Facebook account’s interaction with MenuGem®.

PCI Compliance

As an Authorize.net merchant, we are required to be compliant with the Payment Card Industry Data Security Standard (PCI DSS), a set of comprehensive requirements developed by the major card brands to facilitate the adoption of consistent data security measures. MenuGem® complies and has always complied with the Payment Card Industry (PCI) Data Security Standard Requirements.

What Data We Use, and Why

For users that use MenuGem with Facebook Log in, MenuGem sends the user to Facebook to log in to the Facebook platform. After a successful log in on Facebook, the user is returned to MenuGem where user variable values are posted to Facebook OAuth and exchanged for an access token. Once this process is completed, MenuGem saves the email address associated with the user’s Facebook account. This becomes the user’s email address on MenuGem. MenuGem also saves the first name and last name of the user as provided from Facebook. The purpose of this process is to allow the user a method to log in to the website www.menugem.com

Once registered, users can change any of the information provided from Facebook by going to My Account.

For users that use MenuGem WITHOUT Facebook Log in, MenuGem requests the user’s First name, Last name, Display name, Email address, and asks the user to set a password. Users are also asked whether they are a business owner / employee.

Content Ownership

All images, text, and source code (unless otherwise noted) on the site are exclusively owned and copyrighted by MenuGem®. If you contribute comments, menus or business information to the site, we reserve the right to correct or alter the information if necessary. This includes but is not limited to information that has been duplicated.

Some of the views expressed in the content of the site are not the views of the MenuGem® staff. This applies to all content that is contributed by MenuGem® users.

Advertising

MenuGem® has the right to sell advertising, either directly or through advertising partners, on all pages of MenuGem®.com including but not limited to businesses profile pages, menus and item pages.

Account Closings

Users may cancel their own account at any time, under the My Account page. This will shut down your account with MenuGem®, and your user login information will no longer be valid on the site. Although your account will no longer be active, MenuGem® keeps all user data for archival purposes. We do not share the information of closed accounts with anyone.

MenuGem® reserves the right to close your account for offensive language, discrimination based on the grounds of religion, race, gender, national origin, age, marital status, sexual orientation, physical or mental handicaps. MenuGem® will close the account of any user that engages in harassment, threats of physical violence, or inappropriate content. The MenuGem® staff will ultimately decide what content is inappropriate for the site.

Requesting Data Deletion from Your Deactivated Account

Although data from deactivated accounts will not be used outside of MenuGem, users may request deletion of deactivated account data by emailing ryan@menugem.com from the email address associated with the deactivated account. If a user cannot communicate from the email address associated with the deactivated account, MenuGem has the right to request other methods of verification such as a scan or photograph of an official form of identification.

Changes to the Terms of Service and Privacy Policy

We reserve the right to make changes to the Terms of Service and Privacy Policy at any time. We will notify users of the latest changes by keeping the most current version and the modified date of the Terms of Service and Privacy Policy posted at http://www.MenuGem®.com/terms.

Online Ordering

MenuGem® is not responsible for any sickness or health issues that may be involved with the product. This includes but is not limited to, food poisoning or death.

MenuGem® MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED IN THE SITE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, MenuGem® DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MenuGem® WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE, OR PRODUCTS ACQUIRED THROUGH THE SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. MenuGem® RESERVES THE RIGHT TO LIMIT PURCHASE AND PURCHASE QUANTITY. MenuGem® does not offer any warranty or guarantees.

MenuGem® does not sell alcoholic beverages on the website MenuGem®.com.

Refund Policy

Should there be any errors with an order, including but not limited to technical errors or delivery errors, MenuGem® will offer reasonable assistance in the correction of that error.

In certain cases a refund may be issued to the End User. In this case the risk of loss of payment for the order may or may not fall on the restaurant. A refund for an order can be issued up to five (5) days after the order has been placed.
